If I had items I was renting but they were stolen and now I have to pay $5000, is that enough to take the person who took the items to small claims court?

That is more than enough to make it worthwhile to go to small claims court: $5,000.00 is enough to justify hiring an attorney to help you, though you could also represent yourself pro se (act as your own attorney) in small claims court. Small claims offers the advantage of being much faster that other civil courts: usually 2 - 3 months, instead of 9 - 12 months or more, for trial.
