Generally speaking, a person can use any name that they choose as long as it is not meant to defraud. There must be some legal document around that has his name on it for you to be able to obtain the driver's license. You are required to show a legal document to obtain a permit and hence the license. I think that you should speak with someone about straightening it all out. Good luck.
