If your tenants are behind three (3) months in rent and have yet to provide you with an explanation as to when you will get paid any portion of it, you have the option to serve them with a thirty (30) day notice of termination of their lease or a three (3) day notice to pay or quit if you wish them them remain as tenants.

The problem that I see is that you are getting deeper and deeper into them for unpaid rent. I suggest that you consult with a landlord tenant attorney about your situation.
