If I’m 21 and my fiancee is 15 and is pregnant, will the state try to charge me with statutory rape even though her parents aren’t pressing charges?

She will be 16 next year, around the time the baby is due. We plan to be married then being that 16 is the legal age to marry with parental consent. I just wonder what if we arent married when the baby is born? I dont want to be forcibly removed from my child’s life because the state decides they want to charge me.

Given the fact that you are a twenty-one year old adult and your fiance' is a 15 year old minor who is pregnant with your child there is always the possibility that the district attorney's office in the county and state where you are located could charge you as the adult with statutory rape even though the minor's parents are not pressing charges.

What the district attorney's office ends up doing with you in the future is pure speculation with respect to the crime you have admitted to.
