The statute of limitations is the period in which a peron (through the civil process) or the state/DA/Police (through the criminal process) can bring a legal action against you. California Code of Civil Procedure 335.1 states that assault or battery actions can be brought within two years of the offense.
So, yes she can wait until the following day to make a report. She could have waited a year and 364 days. She can also still apply for a domestic violence restraining order. That domestic violence restraining order could keep you from seeing her, calling her, force you to pay her legal costs, force you to leave a joint living situation, or even make you pay certain debts you have together.
