A DUI stays on a record forever. I think that what you are referring to here is the "look back" period. This is the period of time that the court will look back into a driver's record for sentencing purposes.

In IN, the court will look back into a driving record 5 years to see how many offenses that the driver has had. Accordingly, as long as there were no other offenses during this time, this most recent offense will be considered to be the first.
