I am so sorry for your troubles.  You are good to think of this now.  The statute of limitations in a personal injury action in California is two years from the date of the accident.  So you would have until June of 2011 to bring an action.  Did you file an accident report about the incident?  Do you know where the water came from?  Have you been to your doctor as to "causation" of what you believe to be the reason for the difference?  You will need someone to confirm your theory.  Go and see an attorney in your area.  The consultation should be free. And the attorney will be able to tell you what your chances are in proving your case. Good luck.
