A person can only be held a couple of more hours... long enough to process the paperwork associated with the bail. If a jail continues to hold an inmate, that should otherwise be free, then they are subject to liability for a civil rights violation. The inmate can also file a writ of habeas corpus for the unlawful detention of their person. The basically commands the jail to quit messing around and release the inmate.
