You have to talk to whomever holds the intellectual property rights and get their permission, which very likely involves both paying them for the right and giving them right of approval over your use (rights holders want to make sure you are not doing anything which would damage, disparage, denigrate, etc. their property). In the example you give, that would involve speaking with Dr. Martin Luther King Jr.'s family.
