Until a formal separation agreement is in effect, or a final decree of divorce has been issued, both spouses have equal rights to the home (and its contents) as it is still considered to be the "joint marital residence". This is true no matter whose name that the deed/lease may be in. At this point, you should consult directly with a divorce attorney in your area. They can best advise you further.
