You'll need to sit down with a bankruptcy attorney and discuss all of the details of your finances. Filing as a couple is certainly cheaper than filing separately. However, there are many variables here. For one thing, are you both eligible for a Chapter 7 or a Chapter 13, or is just one of you? That will obviously be a deciding factor in whether or not to file jointly or separately. Also, your collective income will make a difference here as will numerous other factors, such as the amount and value of your exempt property.
Again, sit down and consult with an attorney who specializesin bankruptcy cases. You want to make sure that you are doing what is in both of your best interests.
