My employer sent a memo telling everyone that

Unless there exists either an employment contract or union agreement to the contrary, then yes it is legal to fine employees for their cell phone use. The fact is that most work relationships are "at will". This means that a company can set the conditions of the workplace much how it sees fit. If you disagree with those conditions you can refuse to comply but fact termiation or you can quit.
