Does my employer have the right to view my insurance documents for underwritting purposes?

A letter was provided to all employees regarding the insurance health underwriting process. The letter stated that the information was confidential and that no company personnel will have access or view the information provided on the forms. All forms were returned to the insurer sealed by the employees and returned to HR. After the information was received by the insurer the managing partner called and emailed HR personnel regarding the medical conditions mentioned in the insurance forms. As mention the forms were to be private and not be viewed by company personnel.

In some circumstances the employer is allowed to review the health care applications of his or her employees for underwriting purposes.

Read your office's employee manual if this is mentioned in it.

However, if there has been a general e mail by your employer that employee health care applications are not to be viewed internally within the company, but solely by the  representative of the potential health care insurer, then only the health care insurer's representatives can review the applications if any of the employees.

If there has been a violation of the e mail statement where the health care applications of employees were viewed within the company, you might need to sit down with human resources and express your concern about what happened.
