In your state, there is no right to be paid out for earned but unused vacation time when your employment ends. If you had a written employment contract addressing this issue (e.g. stating that you would be paid your unused vacation when your employment ends), you must be paid whatever the contract says. Without a contract, your employer could refuse to pay you any of your vacation time--and if they are voluntarily choosing to give you some of your vacation, they are actually being more generous than they have to be.
