Canmy landlordcharge me a repainting fee if they plan on demolishing the building?

I have a lease that says that I cannot paint my apartment without approval from the landlord. I understand that if I paint they will charge me for a repainting fee after I move out. My building is set to be demolished next winter and I will be the last tenant in that apartment. Can they charge me the repainting fee if no one is ever going to live there after than me?

If you have a written contract with your landlord signed by you and the landlord stating that if you paint the apartment that you are living in without approval of your landlord that you will be charged a repainting fee after you move out, that provision controls assuming that the apartment is in fact repainted after you move out.

From what you have written, you will be the last tenant in the unit because it will be demolished soon after you leave it. If that is so, then there really is no basis for you to pay a fee to the landlord for repainting its interior. Even if the landlord repaints the interior after you leave and the unit is then demolished without any new occupant in your former unit, painting the area that you once occupied makes no economic sense.
