Can my landlord not open the pool at our complex if we were told when signing our lease it would be open?

When we signed our lease we were told there would be 2 pools open from Spring to Fall. Last year they were both open but this year only one is open and it’s the smallest and down the road in a different complex. The one on our side is empty. I moved here because of the location and the pools and now I feel like I’m not being given what I was told I would have when I agreed to sign the lease.

Have you asked your landlord or property manager why both pools are not open at this time? Possibly there might be some explanation such as repairs or the like.

In any event, a pool is an amenity ancillary to the rental of a particular rental, albeit such can be an inducement to have a person rent in a complex where a pool is located.

In your matter, your landlord is entitled to not have the swimming pool that you have written about open for use of the tenants. However, if this is the case, you may be entitled to a bit of a reduction in your monthly rent.
