The fact is that not all workers need be treated the same or even fairly. That is unless such treatment constitutes some form of legally actionable discrimination. So unless such an action is based on an employee's race, religion, nationality, gender, age (over 40), or disability, it is legal. A company/business can set the conditions of the worklce much as it sees fit absent a union agreement or employment contract to the contrary.
