Yes, you may sue if you are not paid--employers must pay employees for all work they did.
Who you sue depends on the business structure. If it is a corporation or LLC, you can only sue the business itself. If it is a sole proprietorship or a partnership, you may sue the owners personally as well.
If they haven't paid you for five checks, there is reasonable chance that either they are out (or are running out) of money, or that someone is stealing or embezzling money. You should action immediately, before more time goes by; the longer you wait, the less chance you will recover anything.
