Original background check was

term care but after five years of
working at Methodist health and
rehab I was terminated due to my
background although nothing has
changed and my charge is not
listed on the unhireable list on
the document

Unfortunately, unless you had a written employment contract limiting the reasons you could be terminated, you were an employee at will, and an employee at will can be fired at any time, for any reason--or even no reason at all--including the employer changing its mind about a years ago background check. So it is very unlikely that as an employee at will, you could successfully sue.
