Can I get back a non-refundable deposit for a wedding venue if the owners consistently failed to communicate with us forcing us to cancel our wedding at their location?

I signed a contract and put down a non-refundable deposit of $400 for a wedding venue. In the last 3 months, I’ve tried making contact with them to no avail to obtain details for my other service providers. 20 emails went unanswered, 10 phone calls not returned, and 1 personal visit and they were closed during regular business hours. We cancelled our contract due to non-communication. Can we get our deposit back?

As you might imagine, the answer will depend, in part, with an attorney of your choice actually reviewing the written agreement and the written communications. Certainly, you have an initial argument for "non-performance" with them not responding to your communications...assuming that you have the correct email and phone contact information.
