Any employer can terminate his or her employee as a result of an incident where he or she suffers an on the job injury. However, the employer by doing so runs the risk of an wrongful termination lawsuit as a result.
The reason is that there is a presumption that the injured employee who has been terminated is being retaliated upon by the employer in that the injury is subject to worker's compensation. If you have been terminated as a result of a work related injury, you should consult with a labor law attorney.
