The issue here is whether the officers simply "busted up" the party or if they searched everyone and reviewed everyone's identification. If they took identification cards (state cards, student cards or driver's licenses) and then explained to you you would need to be tested with a breathalyzer and you failed, as a minor you would most certainly be ticketed. However, if you did not undergo a breathalyzer, I don't see how the officers could have a successful claim against you for minor consumption of alcohol. You may be the subject of a police report that indicates that based on the police officer's observations, you were intoxicated but again, without documentary evidence I don't see how a good lawyer can not have this matter dismissed. You can receive this citation/ticket by mail. Review the facts and see if this is something that you expect to come to you.
