Yes, the police can do this. There is no law or other requirement that police ticket, etc. everyone committing an offense--they can pick and choose who to ticket. You can see this most clearly in the case of speeding: a dozen cars may be all speeding together (all traveling at the same speed), but the police will only pull over one; the failure to pull over the others has no effect on the validity of the ticket they issue or subject the police to any sort of sanctions.
