Has your bank assessed you a fee for going over your balance? If so, you’re in the same situation as millions of Americans – many of whom have been paying steep overdraft fees for years. Banks thought the idea of charging outrageous overdraft fees was great – and the banking industry made over $35 billion off of customers last year alone. Fortunately for customers, some banks are now being forced to reimburse those fees. Find out how you can file a bank overdraft fee lawsuit to recoup any unfair bank transaction fees you’ve paid.

Bank Overdraft Fee Lawsuits

Many Americans have filed bank overdraft fee lawsuits against some of the nation’s largest banks such as Sovereign Bank (Banco Santander, S.A.), Wells Fargo, Bank of America, M&T Bank and Wachovia in order recoup unreasonable fees they allege were charged when their bank account balances fell below a minimum balance. In addition to charging unreasonable overdraft fees, they also claim that banks routinely apply larger transactions before smaller ones – all for the purpose of collecting additional overdraft fees.

An Example Of Bank Overdraft Fees

Here’s an example of how banks assess overdraft fees:

You have $1,000 in your bank and have the following transactions in one day:

Morning: Coffee ($3)
Afternoon: Lunch ($12)
Evening: Rental payment ($1,000)

Your bank may apply the $1,000 rental payment to your account first, thereby creating an “insufficient funds” or “overdraft” status on your account. Your bank then charges you $35 (or possibly more) for each of the other transactions – a total of $105. Had the bank applied the transactions in the order in which you made them, you would have only been assessed a $35 fee.

It’s this situation that bank overdraft fee lawyers say is unfair because the fees are simply unreasonable and are applied unfairly. Numerous bank overdraft fee lawsuits have been filed to assist affected consumers to recoup those overdraft fees. If you would like to find out how to recoup bank overdraft fees assessed against you, contact a bank overdraft fee attorney for more information. In most situations, it’s as easy as gathering up your bank statements.
