Under the laws of all states in this country debts of one spouse incurred during the marriage are the marital obligations of both spouses to be paid from marital assets of the couple assuming there are enough of such assets to pay down such debt. Otherwise the debt is then to be paid from personal assets of the the spouse that incurred such debt during the marriage.
