The officer can arrest you any time within the statute of limitations--- which is three years.  However, this officer isn't just making a decision... he's also asking you to snitch.  This can be dangerous for you.  Before you deside to turn on someone else when you are faced with certain charges, consider consulting wiht a criminal attorney.  Everyone assumes that officers will honor their word.  Unfortunately, not every officer will honor their word and, even if they did, their decision could be subject to revocation by the prosecutor.  A criminal defense attorney can assist you to make sure that any agreements you do reach with the State can be enforced against the state.
