Other car was speeding and my nephew was going 30mph having car trouble. Mother not allowed to see or speak with him. Since he has been charged with vehicular homicide is this legal? She wants to see him. Don’t know yet all details of accident. Witness says other vehicle was at fault.

Get him a criminal defense lawyer in New Mexico IMMEDIATELY so he says nothing that can be used against him. (Check out www.attorneypages.com)

Have the lawyer say he's been retained to represent him and demand that questionning stop.

Someone -- ideally your lawyer -- will also button down the other witness' story so fault is established. But fault is a civil matter, and the criminal matter is far more serious at this stage.
