If the other insurance company is denying coverage for their client, you may find it easier to go to your insurance company, presuming you have collision insurance on your car, and have them pay for the damages and then subrogate against the other company. You will have to pay your deductible until your company can get reimbursed by the other insurance company, but it may be easier than trying to fight it out with the other insurance company. If you do not have collision insurance, then you must work with the other insurance company. Make sure they know of the police report and if you can’t make any progress, ask to speak to a supervisor and see if they can help settle your claim.Your insurance rates will not be affected even though if you go through your insurance company, since the accident was not your fault. Be sure to stay in touch with your agent and/or company to follow the progress of your claim so you can get your deductible back.
