What happens if they cant get a hold of him? I was driving in Orlando with 3 friends. Traffic was hectic and i got into a right line to make a right onto the next intersection. The right lane was moving slow and at one point we were at a stand still. A truck that was parked to the right of my car took that moment to back straight into the passenger side of my car damaging both doors almost evenly. I had the other driver write down his insurance information (but no phone number or address) and told me he knew it was his fault. Police came but made no report. Now the at fault driver isnt answering calls from his insurance co. What now?

If you are in an auto accident and the other driver is responsible, his insurance company needs to speak with their driver before they can work on a settlement with you. If the other driver does not return the phone calls of his insurance company, they will continue to contact him, but won’t offer a payment to you.If you have collision insurance on your car, and the damages are over your deductible, then you can ask your insurance company to pay for those damages. They will then contact the other insurance company and try to work out a settlement with them. They may be able to push them to settle even if they cannot speak with their client. If they can settle with the other insurance company then you will get your deductible refunded. However, if they cannot reach a settlement, you will be out your deductible. At that point you could file a claim in small claims court to try to force the other driver to respond.
