Insurance Question from Santa Ana, CA

Asked on 09/19/2012

What are the consequences for me if I get in an accident without insurance? I got into a fender bender a couple weeks after my policy expired. There was no visible damage to the bumper only some small plastic parts attached to the bottom. We decided that we would handle it between us. After supposedly taking it for an estimate. I was told it would be over $600. So a asked if theycould take it to an auto shop I knew was legit, but they would just make excuses and became difficult after that. What would happen if they reported the accident to their insurance? Would they cone after me? If so how? Would it be reported to the DMV? Would they have to pay their deductibale?

If you have an auto accident that is your fault and you don’t have insurance coverage the other party can go to their insurance company to make the repairs to their car. The deductible for collision coverage will apply to the other party. After the claim is settled, the insurance company will probably come to you to reimburse them for the amount they paid out. They would also try to get the amount of the deductible for the other driver. If they only get a portion of the reimbursement, the other party will only get a portion of the deductible reimbursed. At that point the other driver can sue you in small claims court for the deductible that they had to pay out.You can also receive a ticket for not having insurance, and the cost of getting a policy will probabaly be increased since you had an at fault accident. You could also get your license suspended if you do not get insurance coverage and providing proof to the Dept of Motor Vehicles.
