Insurance premium goes up even though case was dismissed. A few months ago i had my license suspended for a few weeks due to a failure to appear. Eventually my case for speeding and failure to appear charges were dismissed, resulting in 0 points and 0 fines. A few weeks later my auto insurance company (mercury) informs me that my premium goes up because i no longer qualify as a safe driver. Their reasoning was that even though I have 0 points, the temporary suspension on my record doesnt qualify me as a safe driver. The dmv and the court say they cant remove the record. Mercury seems to be using that as an excuse to raise my rate. What can i do?? TY

Each insurance company handles a driver’s license suspension differently. In this case your insurance company feels that if your license was suspended, you are not the superior driver that you may have been considered previously.However, the insurance company cannot increase your premium during the policy term. They must wait for the renewal date to amend the premium. If they did this in the middle of the term, you should go back to them and have them remove the increase until your next renewal.You should talk to your agent, or find another agent or company who will not consider the suspension for the failure to appear as a chargeable incident. Many insurance companies ignore this type of suspension if you are not charged with the ticket. It is always best to shop around. However, if your have additonal tickets or accidents on your record you may not be able to switch insurance at this time.
