Insurance Question from Commerce, CA

Asked on 02/13/2012

I was at fault in an accident.other driver willing not to get ins company involved.does that mean she can set guideliness of how car will be repaired? After rear ending another vehicle and agreeing to settle it ourselves, the other driver got an estimate for the damages at a shop of her choice. Do I have to agree to that or can the car be repaired at another shop with a lower estimate? She said she wanted it done her way but isn't the main purpose for car to be repaired regardless of where the work is done?

Answer given on March 01, 2012

If you rear ended another car, I do not recommend trying to settle the claim yourself. The other party has a year or more to claim bodily injury and if you settle the damages to the car, your insurance company will not be willing to step in to settle the bodily injury claim afterwards. In addition, your insurance company can arrange a payment to the other party at a rate that is reasonable and customary for the area. The other person may be going to a more expensive repair facility. If you still intend to settle this yourself, you are probably going to be stuck with the place the other person chooses. You are not really in a bargaining position. She may want to use the more expensive location because she knows she doesn’t have to pay for it. Call your insurance agent and report the accident to your insurance company. Let them handle this situation. That is why you buy insurance – to protect you and work on your behalf in the event of an accident.
