Insurance Question from Bartlett, NY

Asked on 03/05/2013

I hired public adjuster after house fire, I received settlement but it did not include all the things that were damaged by the fire The settlement did not include things that were damaged from fire. the biggest is the main water line that comes into the house in the cellar (location of fire) was damaged, it now leaks . Ironically had water line inspected one month earlier as I had a higher than normal water bill, no leaks were present. This was told to my public adjuster day after the fire (when the leak of main water line was noticed). five months later we had settlement without cost to fix main water line(estimates are $3700 to $4000) now public adjuster will not return my calls and insurance agent will not pay

The homeowner policy covers you for fire damage to the home and its contents. Since the water main is not a part of the home, the policy will not include the damage to this item. Your agent, adjuster and public adjuster should have advised you of this exclusion. The utility company should be willing to come out and repair the pipe that is damaged. There could be a charge for this service, but it obviously needs to be repaired. If the pipe section is inside the home, there could be coverage if you can prove the damage is from the fire. It would have to have been a very hot fire for the pipe to be damaged, so you may not be able to prove the damage. Again, the utility company may be able to determine the cause of the damage, and may be able to help you get the pipe covered by the loss.
