My auto insurance company is telling me that they are not releasing the funds to have my vehicle fixed because they need to make sure that my application matches my records. They told me I had to put the last 3 years worth of violations and accidents on my application. The problem is that I never filled out an application for Affirmative. They bought out my insurance agency and I never received an application. I pay all my insurance bills over the phone. The last application that I filled out was 5 years ago and so the record will not match. What can I do? Can they do this after I have been with them for a year or more?

Send the CEO a letter stating that you are complaining about their delay in payment, and say you understand that under Illinois law, including the insurance Fair Claims Practices law, they have a duty to pay claims fairly and promptly. Remind them that they took over a block of policies issued by another carrier and that goes not give them license to act in bad faith. Send a copy to the Illinois Insurance Department in Springfield.
