The age of consent in most states is 16 or older. Therefore, a minor under that age cannot agree to have sex no matter how willing they are to engage in the act. Accordingly, the adult is at legal risk; this is true whether or not the minor gets pregnant. Additionally, the older the adult, the greater the penalty.
