Can you prove you took and paid for the policy (such as with proof of payment; the terms of the rental contract and what was "checked off" (so to speak) on it as things you'd bought; etc.)? If you can, then if under the terms of this insurance, you would be covered, they have to pay you--failure to do so would be breach of contract and you could sue them. So the issue will be proving you bought the insurance, and then seeing if this accident would be covered under the policy/insurance.
